DMCA

At MercuryUpload, we take copyright protection seriously. We are committed to complying with the Digital Millennium Copyright Act (DMCA) and expect all users to respect the intellectual property rights of others. This policy explains how to report copyrighted content and how we handle such claims.

Reporting Copyright Infringement

If you believe that material hosted on MercuryUpload.com infringes your copyright, you may submit a formal takedown request. To be legally valid under the DMCA, your notification must include all of the following:

  1. Your full name and contact details, including a valid email address.

  2. A description of the copyrighted work you claim has been infringed.

  3. A direct link (URL) to the specific file or content in question.

  4. A clear statement that:

"I have a good faith belief that the use of the material in the manner complained of is not authorized by the copyright owner, its agent, or the law."

  5. A declaration that:

"The information in this notice is accurate, and under penalty of perjury, I am the owner (or am authorized to act on behalf of the owner) of the copyright that is allegedly infringed."

Filing a Counter-Notice

If you believe a file you uploaded was removed by mistake or misidentification, you may respond with a counter-notice. Your counter-notice must include:

  • Your name, address, and contact info.

  • A reference to the content that was removed (including its previous URL).

  • A statement under penalty of perjury that:

"I believe in good faith that the content was removed or disabled as a result of a mistake or misidentification."

  • A statement that:

"I consent to the jurisdiction of the federal court in my district, or if outside the U.S., the jurisdiction where MercuryUpload is located."

  • Your electronic or physical signature.

Once received, we may reinstate the content unless the original complainant takes legal action within 10 business days.

Repeat Infringement Policy

MercuryUpload enforces a zero-tolerance policy toward repeat infringers. Accounts found to have repeatedly violated copyright rules may be suspended or permanently banned at our discretion.

Important Notes

  • Misuse of the DMCA process—such as submitting false claims—may result in legal liability.

  • We encourage resolving disputes directly before resorting to formal notices.

  • MercuryUpload is a content-neutral platform and does not pre-screen user uploads.
